Previous surveillance of public procurementes in the law 7021/2022

The analisys of good governance and transparency in public procurements focuses frequently on contents of the calls and on subsequent acts after publications. The objet of the public subsequent tenders is considered to fit better the administrative authority´s discretion, in the exercise of its competencies. The supervision of discretional decisions is a subjet in constant evolution. Decisions about the object of the future procurements condition “a priori” quite much their content, because of which it should be possible to wonder if those decisions are really right and suitable. The Republica del Paraguay enacted on december 9th 2022 its new Public Supplies and Procurements Law. The purchase of this paper is finding out if its prescriptions allow, and how much, the supervision of discretional decisions before writing the calls.
