Criticism of the application of Article 58 of DNCP Resolution No. 234/2025

This article provides a critical analysis of Article 58 of DNCP Resolution No. 234/2025, which regulates procedures under Law No. 7021/22. The provision in question establishes that the deadline for submitting protests against bidding documents is calculated based on the date of opening set in the original document, even if subsequent extensions occur. The study argues that a restrictive interpretation of this rule may undermine bidders’ rights and the principles of equality, transparency, and fair competition. A normative revision is proposed to ensure that the calculation of deadlines refers to the latest version of the bidding documents.
