Financial interests and public procurement

Day-to-day transactions are steeped with interest. Public procurement is no exception. However, there is no legal definition of what “interest” means, at least not one in Paraguayan law that we find convincing. The concept of financial interest (we will refer to this as “interest” on money) and the different types of interest were developed by legal doctrine., apart from the regulatory provisions of each country. However, neither Paraguayan legal doctrine, nor Paraguayan economic doctrine, nor national financial doctrine has even attempted to outline what is meant by financial interest (I) and why it is important for public contracts (II). This research will attempt to answer these questions, defining the scope of financial interests in public procurement.
