Three Fundamental Topics in Public Procurement

In this article I intend to present some of the concepts that, in my opinion, are fundamental for the successful management of public procurement carried out within the framework of Law 7021 on Public Supplies and Contracting and that are very often ignored or are not duly considered and this causes unnecessary obstacles and deviations from the main purpose of public procurement.
That is why I will focus in this work on three basic topics - of the many that there are - with the intention of clarifying them to apply them with predictable criteria and they are: (1) a proposed order of precedence of the guiding principles, (2) a distinction between the so-called substantial and formal documents of the offers and, (3) a clarification of what is a substantial or significant deviation of the offer with respect to the bases of the contract
